Terms and Conditions

Welcome to Hequri. These Terms and Conditions govern your use of our window and door installation services. By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires:

  • "Company," "We," "Us," "Our" refers to Hequri, registered at 42 Elmfield Road, London, SW17 8HN.
  • "Client," "You," "Your" refers to the individual or entity engaging our services for window and door installation.
  • "Services" means the installation, repair, replacement, or maintenance of windows and doors as agreed upon in the quotation or contract.
  • "Property" refers to the premises where the Services are to be performed.
  • "Agreement" means the contract formed between the Company and the Client upon acceptance of our quotation.

2. Service Agreement and Quotations

All quotations provided by Hequri are valid for a period of thirty (30) days from the date of issue unless otherwise stated. Quotations are based on the information provided by the Client and following an initial assessment of the Property. Any changes to the scope of work, materials, or specifications requested after acceptance of the quotation may result in additional charges.

The Agreement is formed when the Client accepts our quotation either in writing, electronically, or by payment of the deposit. We reserve the right to refuse service at our discretion prior to the formation of the Agreement.

3. Pricing and Payment Terms

All prices are quoted in British Pounds (GBP) and include VAT unless otherwise specified. Payment terms are as follows:

  • A deposit of 30-50% of the total quoted price is required upon acceptance of the quotation to secure your booking and order materials.
  • The remaining balance is due upon completion of the installation and your satisfaction with the work performed.
  • Payment can be made via bank transfer, credit/debit card, or cash. Payment details will be provided on the invoice.
  • Late payments may incur interest charges at a rate of 3% above the Bank of England base rate per annum.

4. Installation and Scheduling

We will make every reasonable effort to complete the installation on the agreed date. However, installation dates are estimates and may be subject to change due to unforeseen circumstances including, but not limited to, weather conditions, material availability, or access issues. We will notify you as soon as possible of any necessary changes to the schedule.

The Client must ensure that the Property is accessible on the scheduled installation date and that the installation area is clear of furniture, fixtures, and personal belongings. Additional charges may apply if our team is required to move items or if access is restricted.

5. Client Responsibilities

You agree to:

  1. Provide accurate information about the Property and any specific requirements or concerns.
  2. Obtain all necessary permissions, approvals, or permits required for the installation, including planning permission or building regulations approval where applicable.
  3. Ensure that someone over the age of 18 is present at the Property during the entire installation process.
  4. Notify us immediately of any concerns or issues during the installation process.
  5. Inspect the completed work and report any defects or concerns within 48 hours of completion.

6. Warranties and Guarantees

Hequri provides a workmanship guarantee for a period of twelve (12) months from the date of installation completion. This guarantee covers defects in installation workmanship but does not cover damage caused by misuse, negligence, normal wear and tear, or unauthorized modifications.

Manufacturer warranties on windows and doors vary by product and will be provided separately. These warranties are subject to the manufacturer's terms and conditions and are in addition to your statutory rights.

7. Cancellation and Refund Policy

Clients may cancel the Agreement at any time prior to the commencement of work. Cancellation terms are as follows:

  • More than 14 days before scheduled installation: Full refund of deposit minus a £50 administrative fee.
  • 7-14 days before scheduled installation: 50% refund of deposit.
  • Less than 7 days before scheduled installation: No refund of deposit, as materials will have been ordered and scheduled.

If we cancel the Agreement for reasons within our control, you will receive a full refund of any payments made.

8. Limitation of Liability

Our liability under these Terms and Conditions shall be limited to the total amount paid by the Client for the Services. We shall not be liable for any indirect, consequential, or special damages including, but not limited to, loss of profits, loss of business, or loss of opportunity.

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

9. Insurance and Damage

Hequri maintains comprehensive public liability insurance. While we take every precaution to protect your Property during installation, we recommend that you notify your home insurance provider of the work being undertaken. We will not be liable for damage to concealed utilities, structures, or materials that were not identified during the initial assessment.

10. Intellectual Property

All designs, drawings, specifications, and other materials prepared by Hequri remain our intellectual property unless otherwise agreed in writing. These materials may not be reproduced, distributed, or used for any purpose other than the specific project for which they were created.

11. Data Protection and Privacy

We are committed to protecting your personal information in accordance with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018. Personal information collected during the course of our business relationship will be used solely for the purpose of providing our Services and will not be shared with third parties except as necessary to fulfill our contractual obligations or as required by law.

12. Complaints and Dispute Resolution

We are committed to providing excellent service. If you have any concerns or complaints about our Services, please contact us immediately at [email protected] or call +44 782 315 0947. We will investigate all complaints thoroughly and respond within seven (7) business days.

If a dispute cannot be resolved through direct communication, both parties agree to attempt mediation before pursuing legal action. Any legal proceedings shall be governed by the laws of England and Wales, and both parties submit to the exclusive jurisdiction of the English courts.

13. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under this Agreement where such failure or delay results from circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or pandemic situations.

14. Amendments to Terms

Hequri reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with the revision date. Continued use of our Services following any changes constitutes acceptance of the modified terms. However, changes will not affect Agreements already in place unless mutually agreed in writing.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these terms, which shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with any quotation, invoice, or other written agreement, constitute the entire agreement between the Client and Hequri and supersede all prior negotiations, representations, or agreements, whether written or oral.
